ICAF processes your personal data to inform you about (changes) in our services and for customer and visitor research. We also process your personal data if you have registered for the newsletter or have requested it. 

If we request surveys, interviews, polls, etc., this concerns the data you leave behind at that time (the answers you give yourself).  

Together with Rotterdam Festivals, we process personal data (postal code and house number) to generate statistical data (including segmentation based on the Cultural Target Group Model) and to collect information about our audience. The results of the various investigations cannot be traced back to persons. We use the anonymous data for accountability to our subsidy providers, and for example as input for our programming and marketing policy. More detailed information about the Cultural Target Group Model can be found here and you can read more about this processing in the Rotterdam Festivals privacy statement .  

When you send us a message, for example via e-mail or a form on our website, we may save those messages. We may also ask you for personal information in certain situations. We do this to better answer your question.  

The personal data we process may include first and last name, address, e-mail address, date of birth, payment details, visit history, information needs and communication preferences.  

We do not sell or provide your personal data to third parties.

Payment conditions: 

  • If you cancel no later than 14 days before the start of an event or festival, your payment will be returned in full with a deduction of € 25 administrations costs. 
  • If you cancel between 14 and 7 days before an event or festival, we’ll reimburse 50% of your payment with the deduction of an administration fee 
  • If you cancel less than 7 days before the festival, we can no longer return your payment. In that case you may give your festival access to another person. Please inform us of the name of the person replacing you. 
  • All payments are handled by our payment provider Buckaroo. 
    On your account statement the name “Buckaroo” will appear. 

Attention: 

  • Be on time. Once a workshop or performance has started we can no longer let you in. 
  • Mobile phones will have to be turned off completely during workshops or performances. 
  • We often organize our performances or events at other locations. We ask that you respect the rules of the location in question.

Chapter 1 General Article 1.1 When do these terms and conditions apply?  

These General Terms and Conditions for Visitors apply to every agreement between the Stage and a Visitor (and to all actions for the implementation of that agreement). In addition, these General Terms and Conditions for Visitors apply to anyone who attends an Event, without the person concerned having directly or indirectly concluded an agreement with ICAF.  

Article 1.2 What do the terms mean?  
 In these general terms and conditions for visitors, the following definitions apply: a. Visitor: any person who does not act in the exercise of a profession or business, and who directly or indirectly enters into an agreement with ICAF in the context of attending an Event, as well as anyone who is in or around any of the Event Locations and who has concluded an agreement with the organizer, whether directly or indirectly. b. Stage: Dutch concert halls, theatres and other stages that are affiliated with the Association of Theater and Concertgebouw Directors (VSCD), or stages that have indicated that they apply the terms and conditions for visitors. c. Location: the actual location of the Event. As well as online, all areas, spaces, fields etc. around it, within which the Event takes place. d. Building: the physical Building of the Stage, which should also include that part of the public road adjacent to the Building to which the Stage is in any way legally entitled or another Place. e. Event: any performance, performance or manifestation that takes place in the Building and/or the Place or via a digital live stream organized by ICAF. f. VSCD: Association of Theater and Concertgebouw Directors in the Netherlands, located at Overhoeksplein 2, 1031 KS in Amsterdam, Chamber of Commerce 40531525. A current list of affiliated members can be found at www.vscd.nl.  

Chapter 2 – Ticket sales  

Article 2.1 When is the agreement concluded?  

The agreement between the Stage and the Visitor is concluded at the moment the Visitor purchases an admission ticket for the Event from the Stage or via a third party.  

Article 2.2 Offers 
All offers, (program) announcements, announcements or otherwise provided information and quotations made by the Stage or by third parties are without obligation, the sale of an admission ticket to the Visitor is not obligatory. ICAF accepts no liability for any errors in offers made to the Visitor by ICAF and by third parties, (program) announcements, communications or otherwise provided information and quotations, and/or for errors made during the (advance) sale of tickets by third parties, including the so-called presale addresses.  

Article 2.3 Risk 
From the moment the admission ticket is made available to the Visitor, the Visitor bears the risk of loss, theft, damage or misuse of the admission ticket. In the event of loss, damage or misuse of the admission ticket, the Visitor is not entitled to a refund of the admission ticket and/or other costs. Even if the Visitor has obtained the admission ticket from a third party (not the Stage) and the payment of the admission price by that third party to the Stage does not take place for reasons on the part of the third party, the Visitor is not entitled to a refund of the admission ticket and /or other costs. If, for whatever reason, the Visitor does not use the admission ticket, this will be at their own expense. Once an admission ticket has been obtained, it cannot be exchanged. 
 
Article 2.4 Admission ticket. Admission ticket not received. Is the Visitor obliged to show an admission ticket?  
The holder of the admission ticket who is the first to show the admission ticket at the start of the Event will be admitted. ICAF assumes that this holder is also the rightful claimant and is not obliged to investigate the validity of the admission ticket and/or the identity of the holder. ICAF cannot guarantee receipt of the admission ticket. If the Visitor has not received an admission ticket, they must report this to the Stage in good time before the Event. Timely means at a time before the start of the Event so that ICAF can invalidate the purchased admission ticket and issue a new admission ticket. If the admission ticket has been purchased at ICAF or a (advance) sales address, the Visitor will receive a new admission ticket. The Visitor bears the burden of proof that he has purchased the admission ticket from ICAF or an (advance) sales address. In the absence of proof, the Stage is not obliged to provide the Visitor with a new Admission Ticket. If requested, the Visitor is obliged at all times to be able to show their admission ticket – physical or digital – and any card that entitles them to a discount on this admission ticket to officials of ICAF. The admission ticket will in any case be shown upon entry to (the relevant room in) the Building or the Place, even if the Visitor has temporarily left (the relevant room in) the Building or the Place during an Event. the Visitor is obliged at all times to be able to show his admission ticket – physical or digital – and any ticket that entitles him to a discount on this admission ticket to officials of ICAF.  
Article 2. 5 Maximum number of admission tickets  

ICAF has the right to set a maximum number of admission tickets to be ordered per Visitor. The Visitor is obliged to comply with this.  

Article 2. 6 Admission ticket and access after start or end?  

The admission ticket is issued once and entitles the Visitor to an Event. An admission ticket does not entitle them to access (the relevant room in) the Building or the Place after the start or after the relevant Event. With a livestream, it may be possible to participate after the start of the Event. It is not possible to watch the performance afterwards.  

Article 2. 7 Other costs on top of the admission ticket price  

ICAF may charge the Visitor a fee in addition to the admission ticket price to cover the costs associated with the conclusion of the agreement .  

Article 2. 8 Watching a livestream performance  

With an admission ticket, the Visitor can view a livestream performance on one device only once. The livestream performance may only be watched in a domestic circle. It is forbidden to look in a larger organized context.  

Chapter 3 – Resale admission ticket  

Article 3.1 Admission ticket for own use, prohibition on resale  
The Visitor is obliged to keep the admission ticket for an Event for himself and may not resell the admission ticket for an Event in any way to third parties, offer it for sale, or provide it for commercial purposes.  

Article 3.2 Prohibition of advertising  

The Visitor may not in any way advertise or make any (other) form of publicity in connection with the Event and/or a part thereof if this is done with the intention of selling or reselling the admission ticket, all this to judgment of the stage.  

Article 3.3 Transfer of admission ticket 

The Visitor who gives their admission ticket to a third party free of charge and not for commercial purposes is obliged to impose the obligations imposed on him as a Visitor as set out in these General Terms and Conditions for Visitors on the person to whom he transfers the admission ticket. The Visitor guarantees to the Stage that these third parties will comply with their obligations.  

Article 3.4 Invalid admission ticket  

An admission ticket that has been or will be resold and/or used for commercial purposes may be declared invalid by the Stage. An admission ticket declared invalid does not entitle the Visitor to (further) access to the Event, and the Visitor is not entitled to a refund.  

Article 3.5 Penalty in case of violation (consumer and non-consumer) 
If the Visitor is not acting in the exercise of a profession or business (hereinafter: consumer), then the Visitor is in violation of any obligation asreferred to in this article, an immediately due and payable fine of € 1,000.00 per violation per admission ticket to ICAF and € 250.00 for each day that the violation continues, with a maximum of € 15,000.00, without prejudice to the right of ICAF to demand compliance and/or compensation from the Visitor for the damage suffered or to be suffered. If the Visitor is not a consumer, then in the event of a violation of any obligation as referred to in this article, the Visitor will owe an immediately due and payable fine of € 10,000 per violation per admission ticket to the Stage and € 5,000 for each day that the violation continues with a maximum of € 40,000, without prejudice to the right of ICAF to demand compliance and/or compensation from the Visitor for the damage suffered or to be suffered. 
 
Chapter 4 – Staying in the Building  

Article 4.1 Good behavior, denial of access  

During the stay in the Building or the Place, the Visitor is obliged to behave in accordance with public order, good morals and (with regard to the nature of the attended Event) applicable rules of decency. The Visitor is also obliged to follow the house rules and instructions of ICAF’s officials known as such. If the Visitor acts in any way contrary to these standards, house rules and/or instructions, the Visitor may be denied (further) access to the Building or Place, without the Visitor being entitled to compensation for his admission ticket and/or other cost. In this case, access can be denied indefinitely or for a specific period of time.  
Article 4.2 General House Rules  

The Visitor is (among other things) prohibited from: a. hindering other Visitors by, including but not limited to, inappropriate behavior and theft; b. to bring objects or substances into the Building or the Place or to carry them with them in the opinion of an official of ICAF or to bring them with them dangerous and/or nuisance to the Visitors; c. to offer goods of any kind for sale to third parties, or to provide them free of charge without the explicit permission of ICAF; d. bring your own food and/or (alcoholic) drinks into the Building or to the Place. e. displaying public intoxication or entering the Building or Site under the influence of drugs; f. Bringing (domestic) animals, not being an assistance dog, into the Building or Place.  
Article 4.3 Checking luggage  

The Visitor is obliged to cooperate with a body search (including any check of (hand) luggage) when visiting an Event. If the Visitor refuses to cooperate, the Visitor may be denied (further) access to the Building or the be denied a place without the Visitor being entitled to a refund of the admission ticket and/or other costs  

Article 4.4 Photo and film recordings  
For the benefit of the performer(s) and fellow visitors, the Visitor is prohibited from making photo, video, film and sound recordings without permission from the Stage, and/or from using suitable equipment during the Event. The Visitor is not permitted to reproduce, distribute or broadcast (a single part of) the (livestream) performance in any form and by any means whatsoever, or to store it in a database or retrieval system. In the event of a violation, the Visitor may be denied (further) access to the Building or Place and a fine may be imposed as laid down in Article 3.5, without the Visitor being entitled to a refund of the admission ticket and/or other costs.  

Article 4.5 Smoking ban 
A smoking ban applies within the Building or Place, with the exception of any designated smoking areas. An official of the Building or the Place has the right, in the event of a violation, to deny the Visitor (further) access to the Building or the Place, without the Visitor being entitled to a refund of the admission ticket and/or other costs.  

Article 4.6 Wardrobe use 
ICAF can oblige the Visitor to use a locker, or to hand in the coat, bag and/or other large objects at the cloakroom. Including and not limited to: suitcases, prams, wheelchairs, umbrellas, helmets, motorcycle suits, walkers, child seats, etc. The obligation to hand over the above goods is only possible if the cloakroom is guarded during the Visitor’s presence. ICAF may charge a fee for the use of the cloakroom or locker. One receipt will be issued for each object issued. Objects will only be returned against presentation of this receipt. Exclusively in the case of paid cloakroom, the liability of ICAF is at all times limited to € 150 for each object (including content) delivered to the cloakroom. ICAF is not liable for damage other than damage to or in connection with the loss of an object itself, and therefore not for indirect and/or consequential damage. Items issued will be kept by the Stage exclusively for the duration of the Event. The Visitor is obliged to collect items deposited at the cloakroom at ICAF before leaving the Building or Place. If a deposited object is not collected after an Event, ICAF has the right not to make a return. Every contract of storage ends at the time of closing of the Building or Place, following the Items issued will be kept by the Stage only for the duration of the Event. The Visitor is obliged to collect items deposited at the cloakroom at ICAF before leaving the Building or Place. If a deposited object is not collected after an Event, ICAF has the right not to make a return. Every contract of storage ends at the time of closing of the Building or Place, following the Items issued will be kept by the Stage exclusively for the duration of the Event. The Visitor is obliged to collect items deposited at the cloakroom at ICAF before leaving the Building or Place. If a deposited object is not collected after an Event, ICAF has the right not to make a return. Every contract of storage ends at the time of closing of the Building or Place, following thedeposit of the object.  

Article 4.7 Minimum age  

The Stage may refuse a Visitor if he has not reached the minimum age specified by the performer/impresario of the Event. There is no refund of tickets and/or other costs that have already been purchased.  

Article 4.8 Identification  

The Visitor may be asked by an official of the Stage to identify himself. If the Visitor cannot show identification, or refuses to show it, the Visitor may be refused access to the Building or Place, without the Visitor being entitled to a refund of the admission ticket and/or other costs.  

Article 4.9 Personal data 
The personal data of the Visitor, including the data relating to the name, address, postal code, place of residence, telephone number, gender, date of birth and e-mail address of the Visitor, which are registered by ICAF in connection with the sale of a admission ticket, will be included in the administration of the Stage and possibly provided to the relevant partner(s) at the Event. The purpose of this administration is the management of and access to personal data for administrative actions, visitor origin analysis and mailings . As a data subject, the Visitor can at all times invoke the right of inspection and/or unsubscribe from receiving the mailings. ICAF processes personal data in accordance with applicable laws and regulations and in accordance with its privacy policy, which can be found on the website of ICAF.  

Article 4.10 Video recording  

ICAF has the right to make (or have made) video and/or sound recordings of the Event at which the Visitor is present, before, during and/or after the Event. ICAF acts in accordance with the General Data Protection Regulation (GDPR) by not displaying the Visitor in an identifiable manner. The starting point here is that a person is identifiable if his identity can reasonably be established without disproportionate effort. 

Chapter 5 – Liability Stage and force majeure 
Article 5.1 Liability Stage  
The Visitor’s stay in the Building or Place is entirely at his/her own expense and risk. ICAF is only liable for material and/or consequential damage suffered by the Visitor or injury inflicted on the Visitor, which is directly and exclusively the result of intent or gross negligence on the part of ICAF and/or its officers. Only that damage for which the Stage is insured, or should have been insured in reasonableness and fairness, is eligible for compensation, and only for the applied maximum insured amount resp. maximum EUR 25,000 per event if no payment is made by the insurance, for whatever reason, the liability of the Stage is limited to an amount of EUR 25,000 per event or series of related events. The liability of the Stage is excluded for, among other things: a. damage resulting from the actions of third parties, including persons engaged by the Stage and tenants of (spaces in) the Building or Place and the persons engaged by these third parties; b. damage as a result of non-compliance with instructions given by the officials of ICAF and non-compliance with generally applicable rules of decency; c. (consequential) damage as a result of unforeseeable changes in the start and closing times of the Events to which the agreement between the Stage and the Visitor relates; d. damage caused by other Visitors.  

Article 5.2 Force majeure, illness/cancellation player 
In the event of force majeure, including, in this context, illness and/or cancellation of the player(s), the Stage has the right to postpone the Event to a later date or to cancel the Event.  

Article 5.3 Relocation Event 
If the Event is moved through the Stage, the admission ticket remains valid for the new date on which the Event will take place. When relocating, ICAF can also choose to issue new tickets for the Event. In that case, the previously issued admission tickets will expire. If the Visitor cannot or does not want to visit the Event on the new date, he has the right to hand in his admission ticket to the party where the admission ticket was purchased and he will receive a refund of the admission ticket and/or other costs. This refund will only take place if the Visitor submits a valid and undamaged admission ticket to the (advance) sales address within twelve weeks from the date on which the Event was to take place. In the event of force majeure, only the Visitor who is a consumer and has purchased the admission ticket at ICAF or an official (advance) sales address is entitled to a refund of the service costs. In the event of force majeure, the Stage is not obliged to compensate other damage, even if the Stage enjoys an advantage as a result of the force majeure. The Visitor cannot claim (replacement) access to another Event. 
Article 5.4 Force majeure Stage  

In addition to Article 6:75 of the Dutch Civil Code, the Stage is not liable for damage suffered by the Visitor, including the refund of the admission ticket and/or other costs, which has arisen as a result of force majeure on the part of the Stage. Force majeure is also understood to mean any circumstance independent of the will of ICAF – even if this could already be foreseen as a possibility at the time of the conclusion of the agreement – which temporarily or permanently prevents fulfillment of the agreement, as well as, insofar as not covered by this already understood, fire, strike, weather conditions, government-imposed measures to prevent the spread of disease, terrorist threat and malfunction.  

Chapter 6 – Complaints  
Article 6.1 Time limit  

Complaints about the performance of the agreement between the Stage and the Visitor must be submitted to the management of the Stage within eight days after the performance of the agreement has taken place or should have taken place. If complaints are submitted after this period, the management of ICAF may decide not to deal with them.  

Article 6.2 Complaint unfounded if:  

Complaints are not possible with regard to the following complaints and circumstances, and do not lead to any obligation to pay compensation on the part of the Stage: Complaints and circumstances that relate to: a. changes in the program, including, but not limited to, changes to the persons or players in the composition of the program, time frame of the program and rescheduling of Events to another date; b. the quality of the performances of the Events to which the agreement between the Stage and the Visitor relates; c. nuisance or inconvenience caused by other Visitors or unlawful intruders, including but not limited to noise nuisance, inappropriate behaviour, theft and destruction; in the event of repeated nuisance or inconvenience caused by specific Visitor(s) to be further identified, the Stage will do everything possible to deny these Visitors access in the future (if necessary); d. nuisance or inconvenience caused by maintenance work on the Building or Site, and/or on the consequences of such maintenance work that could reasonably be carried out at that time; e. nuisance or inconvenience caused by the improper functioning of facilities in the halls of the Building or Place; f. nuisance or inconvenience, including limited visibility for the Visitor, caused by (sound) recordings by the media and the resulting technical facilities in the halls; g. (noise) nuisance caused by simultaneously taking place Events, including necessary actions that are necessary for the preparation for these Events, or that are in any other way related to these Events, in other areas of the Building or the Place; h. the allocation and distribution of seats and/or a change to the seat plan required by circumstances; i. nuisance or inconvenience, including limited view of the stage and/or surtitles; j. the presence or absence of surtitles, caused by the malfunctioning of the technical facilities, or the choice of the Stage whether or not to offer that facility; k. nuisance or inconvenience caused by public transport strikes; l. denial of access to an Event that has already started. 
Chapter 7 – Rights of the Stage  

Article 7.1 Invalid admission ticket in the event of a violation  

In the event of a violation by the Visitor of (one or more of) the provisions referred to in these General Terms and Conditions for Visitors, the Visitor will be in default by operation of law without further notice of default being required and the The Company is entitled to dissolve the purchase with immediate effect and without judicial intervention and/or to refuse the Visitor (further) access to the Event, for example by invalidating the Admission Ticket, without the Visitor being entitled to a refund of any compensation. An invalid Admission Ticket does not (any longer) entitle you to admission to the Event.  

Article 7.2 Counterfeiting  
If it is plausible that the admission ticket has been forged, the Stage has the right to refuse the holder of this admission ticket (further) access to the Event, without the Visitor or the holder being able to claim any damage that he or she may incur will suffer from this.  

Article 7.3 Camera surveillance  

The Stage can keep camera surveillance in the Building or at the Place where the Event is organized. The camera surveillance can take place before, during and/or after the Event to protect persons and property of the Stage and/or third parties. Camera images will be kept for a period to be determined by ICAF and will be made available to the police if necessary.  

Article 7.4 Incidental exercises and evacuation 
ICAF has the right to adjust the (regular) opening hours to incidental exercises in the context of company emergency response or, in the event of a calamity, to evacuate the Building or Place in whole or in part, without the Visitor being entitled to a refund of the admission ticket and/or other costs and/or compensation.)  

Chapter 8 – Other conditions  

Article 8.1 Changes to visitor conditions 
ICAF is entitled to unilaterally change the General Terms and Conditions for Visitors. In that case, ICAF will inform the Visitor of the changes in a timely manner. If the Visitor is a natural person who does not act in the exercise of a profession or business, and the change results in the Visitor being provided with a performance that differs substantially from the original performance, this customer has the authority to dissolve the agreement. as of the date on which the amended General Terms and Conditions for Visitors come into effect.  

Article 8.2 Other terms and conditions  

The Stage may have additional terms and conditions to these General Terms and Conditions for Visitors and/or regulations apply. ICAF is also free to declare parts of these General Visitor Conditions inapplicable. The invalidity of a provision of these General Terms and Conditions for Visitors does not affect the validity of the other provisions. ICAF does not accept the applicability of the Visitor’s general terms and conditions in advance.  

Chapter 9 – Applicable law / Competent court  

Article 9.1 Dutch law  

These General Terms and Conditions for Visitors and the agreement between the Visitor and the Stage are governed by Dutch law.  

Article 9.2 Forum 
All disputes arising from the agreement between the Visitor and the Stage will be settled exclusively by the competent court in the place where the Stage has its registered office, unless the law expressly provides otherwise.
